Terms of sale

These General Terms and Conditions of Sale govern the purchase of products through the shop on the website davidcata.com. By placing an order, the customer confirms that they have read and accepted them. We recommend keeping or printing a copy.

2. Products

The shop offers limited-edition prints (signed and numbered), art prints, garments and music by the artist. Product photographs are indicative; as these are artworks, slight variations in colour or finish inherent to each piece may occur.

Unique original works and sold-out pieces are not available for direct purchase through the shop: they are shown for information only and may, where applicable, be enquired about by email. Personalised commissions (bespoke portraits or paintings) are not contracted through the shop but individually via the contact section, and are governed by what is agreed in each case.

3. Prices

Prices are shown in euros (€) and include the applicable VAT (10 % on the artist’s own artwork and 21 % on other products). Shipping costs are not included in the product price and are calculated and shown separately before completing the purchase, according to the chosen destination zone.

The seller may change prices at any time; the applicable price is the one displayed on the website when the order is confirmed. In the event of an obvious typographical error in a price, the seller may cancel the affected order and refund any amount paid.

4. Purchase process

The customer selects the products, adds them to the cart, chooses the shipping zone and enters their details, and makes the payment. After payment, they will receive a confirmation email with the order details. The contract of sale is deemed concluded upon that confirmation.

The seller may decline or cancel an order due to lack of stock, an error in the price or product information, or the impossibility of shipping to the indicated destination, refunding in full any amount paid.

5. Payment methods

Payment is made by bank card or Bizum through the secure Stripe payment gateway. The seller neither accesses nor stores the customer’s full card details, which are handled directly by the payment provider under its own security standards.

6. Shipping and delivery

Shipping costs apply according to the destination zone:

• In-person pickup in Viveiro: free (by prior arrangement via email).
• Spain (mainland): €7
• Europe: €18
• Rest of the world: €35

Delivery times are indicative and depend on the carrier and destination. The seller prepares and hands the order to the carrier within a reasonable period from payment confirmation. Any import taxes, duties or fees outside the European Union are borne by the customer.

7. Right of withdrawal and returns

The consumer has 14 calendar days from receipt of the product to withdraw from the purchase without justification, except for the cases set out in section 8.

To exercise it, simply notify the seller by email at contacto@davidcata.com, stating the order, before the deadline expires. The customer must then return the product within a maximum of 14 days, unused and in its original condition and packaging. The direct cost of return (return shipping) is borne by the customer.

The seller will refund the product price by the same means of payment within 14 days of being informed of the withdrawal, and may withhold the refund until the product is received. If the returned item shows a diminished value due to handling beyond what is necessary to check it, the seller may deduct that decrease from the amount to be refunded.

8. Exceptions to the right of withdrawal

Under Article 103 of Royal Legislative Decree 1/2007 (Spanish Consumer Protection Act), there is no right of withdrawal for the supply of goods made to the customer’s specifications or clearly personalised. Commissions and bespoke works (for example, made-to-order portraits or paintings) are therefore excluded.

9. Defective, damaged or incorrect products · Warranty

If the product arrives defective, damaged in transit or does not match the order, the customer must notify contacto@davidcata.com as soon as possible. In these cases, the seller will bear the return costs and will, as appropriate, repair, replace or refund the product.

Products carry the legal warranty of conformity of 3 years provided for new goods under the applicable consumer legislation.

10. Intellectual property

All artwork, images, designs and texts on the site and in the products belong to David Catá and are protected by intellectual property law. Purchasing a piece does not transfer any exploitation rights over the work: in particular, it does not authorise reproducing, distributing, publicly communicating or transforming it, nor making or selling copies. The purchase grants only ownership of the physical copy for private use.

11. Liability

The seller is liable for the correct performance of these terms as provided by law. It shall not be liable for delays or failures arising from causes beyond its reasonable control (force majeure, incidents involving carriers or the payment gateway, among others).

12. Customer service and complaints

For any query, incident or complaint, the customer may contact contacto@davidcata.com. Official complaint forms are available to consumers.

The European Commission also provides an online dispute resolution platform, available at ec.europa.eu/consumers/odr.

13. Applicable law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute, and where the customer acts as a consumer, the competent courts shall be those established under consumer protection legislation, generally those of the customer’s place of residence.

14. Amendment of the terms

The seller may update these terms at any time. The version applicable to each order will be the one published on the website at the time the order is placed.
